Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Brail at brail.app and related interfaces (the "Service"). By connecting a wallet or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Brail lets you make short-horizon directional predictions on live cryptocurrency spot prices sourced from supported exchanges. Correct calls earn points; incorrect calls do not. Each prediction requires a fixed, disclosed commitment fee paid on-chain in USDC or Oarcoin (OAR) on the Base network. Fees fund weekly reward pools (94% to traders with points in the matching token pool; 6% supports platform operations). The Service is not a custodial exchange, broker, or securities platform.

Eligibility

• You must be at least 18 years old (or the age of majority where you live).
• You must not be located in, or a resident of, any jurisdiction where use of the Service or crypto transactions is prohibited.
• You are solely responsible for determining whether your use complies with local laws, including tax and gaming or financial regulations.
• You may not use the Service if you have been suspended or banned by us.

Wallet and self-custody

You connect a self-custody wallet through Privy. You alone control your wallet and private keys. We cannot recover lost seed phrases, reverse transactions you sign, or move funds without your explicit on-chain approval. You are responsible for:

• Verifying you are on the official domain before connecting or signing.
• Reviewing every transaction — token, amount, and network — in your wallet before approval.
• Maintaining device and wallet security.
• Ensuring your wallet is on Base (or Base Sepolia on testnet) when using the Service.

What we never ask for

Brail will never request your seed phrase, private key, recovery words, exchange password, or traditional payment card details. Support will never ask you to "validate" your wallet by sending your secret recovery phrase. Legitimate interactions require only: wallet connect, and ERC-20 transfers or claims that you initiate and sign for disclosed amounts shown in the app.

Predictions and commitment fees

• Each prediction is final once submitted and the commitment fee transaction is confirmed on-chain.
• Fees are fixed per horizon and payment token as displayed before you commit — not proportional to stake size beyond that fixed fee.
• You select token, exchange, horizon, and direction (up or down). Double-check the recap before signing.
• Predictions cannot be cancelled by you after submission except where the Service voids a prediction due to an unrecoverable exchange price feed failure (feed void), in which case the commitment fee is refunded on-chain.
• Tie outcomes (price unchanged at settlement) void the prediction for scoring purposes; commitment fees are not refunded for ties unless documented otherwise.

Settlement and pricing

Outcomes are determined automatically using live spot prices from the same supported exchange selected for the prediction, sampled at horizon close — matching the live spot shown in the product UI. If that live feed is unavailable after reasonable retries, settlement may use the venue’s last fully closed 1-minute candle, or the prediction may be voided and the fee refunded. Displayed charts and prices are for information; the settlement oracle logic in our systems and documentation is authoritative for scoring.

Points, leaderboard, and rewards

• Points are awarded for correct predictions according to published horizon weights. Points have no guaranteed cash value outside the weekly reward pool mechanics.
• Leaderboard rankings reflect platform-calculated statistics and may be filtered by time window.
• Weekly USDC and OAR reward pools are separate. Your claim depends on points earned that week in the matching payment token relative to other participants in that pool.
• Claims require a wallet-signed on-chain transaction using a Merkle proof after the epoch is finalized. Failed claims should be retried from the Rewards page; contact support with a transaction hash if needed — never share your seed phrase.
• We may adjust points formulas, fee splits, or reward schedules with notice via documentation updates; changes apply prospectively unless required for security or legal compliance.

Prohibited conduct

You agree not to:

• Impersonate Brail, our team, or other users.
• Use bots, exploits, or manipulation to distort prices, settlement, leaderboards, or rewards.
• Attack, scrape, or overload the Service in ways that harm other users.
• Use the Service for money laundering, sanctions evasion, or other illegal activity.
• Circumvent geographic, wallet, or rate limits.
• Phish users or operate lookalike sites requesting seed phrases or excessive token approvals.

Intellectual property

The Service, including branding, UI, documentation, and software (excluding open-source components and third-party marks), is owned by Brail or its licensors. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. Token and exchange logos are property of their respective owners.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION, OR THAT EXCHANGE DATA WILL ALWAYS BE AVAILABLE OR ACCURATE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAIL AND ITS OPERATORS, CONTRIBUTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF THE SERVICE, WALLET COMPROMISE, SMART CONTRACT BUGS, BLOCKCHAIN CONGESTION, OR THIRD-PARTY SERVICES — EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE GREATER OF (A) THE COMMITMENT FEES YOU PAID TO THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

Indemnification

You agree to indemnify and hold harmless the Service operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

Suspension and termination

We may suspend or restrict access if we reasonably believe you violated these Terms, pose a security risk, or where required by law. On-chain records and prior settlements remain unaffected. Provisions that by nature should survive (disclaimers, liability limits, indemnity, governing law) survive termination.

Changes to these Terms

We may modify these Terms by posting an updated version with a new date. Material changes will be communicated via the Service or documentation. Your continued use after the effective date constitutes acceptance.

Governing law and disputes

These Terms are governed by applicable law in the jurisdiction of the platform operator, without regard to conflict-of-law rules. Disputes should first be raised via the contact channel below. Where permitted, you agree to attempt informal resolution before pursuing formal proceedings.
